DUI, All Criminal, Traffic Matters, Personal Injury, and Wrongful Death
SELECTED BY HIS PEERS 2007, 2008, 2009, 2010, 2011, 2012, 2013, 2014, 2015, 2016 AND 2017 AS MARYLAND SUPER LAWYER CRIMINAL DEFENSE: DUI/DWI
I am a former Assistant State's Attorney for Baltimore City and have been in the private practice of criminal and drunk driving law for over 30 years. My tag says "No Plea" because I am known for trying cases. Many lawyers look to get in and out of court as quickly as possible. My objective is to secure the best possible outcome for my clients. I'm no pallbearer. I handle all state and federal criminal and traffic matters, including appeals to the Court of Special Appeals and the Court of Appeals. I can assist with criminal and DUI matters throughout Maryland including Anne Arundel County (Annapolis and Glen Burnie), Baltimore County (Catonsville, Towson, and Essex), Carroll County, Cecil County, Harford County, Howard County, and Baltimore City.
I have been named Maryland Super Lawyer for Criminal Defense: DWI/DUI for 2007, 2008, 2009, 2010, 2011, 2012, 2013, 2014, 2015, 2016 and 2017. I have also been selected for inclusion in the 2008, 2009, 2010, 2011, 2012, 2013, 2014, 2015, 2016 and 2017 editions of The Best Lawyers In America in the practice of DUI/DWI Defense. I have been AV Peer Review Related by Martindale-Hubbell since 1990. This is the "Highest Possible Peer Review Rating In Legal Ability & Ethical Standards" by this organization that uses peer review to evaluate lawyers in the United States and Canada.
In addition to DUI defense, I am actively engaged in the defense of people accused of all criminal matters. The defense of drug distribution and drug possession cases make up a considerable part of my criminal practice.
I have co-authored books and taught continuing legal education courses for criminal defense lawyers since 1982.
These are reference books that even the judges make use of:
In November 2003 I successfully completed the 24 hour National Highway Traffic and Safety Administration (NHTSA) training course for administration of Standardized Field Sobriety Tests. This training provides me with an inside look at the actual police training and what was required at the roadside when you were administered these exercises.
I have been lecturing on the defense of these cases to Maryland lawyers, judges, prosecutors, and police for over 30 years. Drunken driving cases are not easy to defend. The proper defense of a drunk driving case requires at a minimum, knowledge of the client's medical, educational, and emotional background; field sobriety testing; and the operation of the breath testing equipment. Not all lawyers educate themselves or are willing to spend the time preparing and trying these cases. There is no expedient way for a lawyer to keep your driving privilege and keep you out of jail.
There are no guarantees that a lawyer can give other than to use his expertise and skill to work diligently on the defense of your case. Judges' assignments are constantly rotated, and any reliance on a statement that a certain judge will hear your case and go easy is just an attempt to gain your business. You have no recourse when the "easy" judge is not sitting the day of your trial and you show up unprepared for trial. Every case should be prepared for trial, even if there is a likelihood of a plea. This is how I practice law, and my clients have the assurance that their case is as important to me as it is to them.
I have tried every type of criminal case as a prosecutor as well as a defense attorney. As a prosecutor I was in the misdemeanor trial division, the white-collar fraud division, and the felony trial division.
My criminal practice includes the defense of all drug cases in State and Federal Court. These cases have a terrible impact on your future, and you have to fight to keep this type of charge from destroying your future. If you have a substance abuse problem, I deal with it immediately. I handle all felony and misdemeanor cases from petty theft to murder. Everyone is entitled to aggressive representation no matter how heinous the offense is viewed. People do get charged with sexual offenses or child abuse because the complainant or family member has an ulterior motive. These charges are easy to make and people do not want to believe they could be made up. Well sometimes they are, and we have to work hard to uncover the motive and helpful witnesses, so that you are not unjustly convicted. Complainants get social workers, advocates, victim-witness representatives, so that recanting and telling the truth does not become an option because there are too many people invested in the complainant's “victim” status. Your lawyer is the only advocate and friend that you have in these types of cases. Not every criminal case is winnable, but you need excellent representation to minimize your sentence and the collateral consequences from any conviction. Call to discuss your case immediately.
Personal Injury and Wrongful Death
There are many law firms who do Personal Injury and Wrongful Death work and turn your file over to their para-legals to do all the work. I do my own work. In my last Wrongful Death case, the insurance company hired lawyers from 2 large law firms, one in Philadelphia and one in Washington DC. By the end of the case they were complaining about how much I was papering them and that I was “too aggressive” towards them. In fact, I almost had the judge remove the lead counsel “Super Lawyer” because I caught him misrepresenting facts when I took the Corporation President’s deposition. The President got so angry at my questioning at the deposition that he walked out to regain his composure. He came back and answered the questions. I out worked both law firms because I worked 7 days a week when the case demanded it. The Sunday before trial the “Super Lawyer” called and the case was resolved the way I had insisted from the beginning. You have to make sure the lawyer you hire is the one who is going to do the work and know your case, otherwise you may not get the best result.
