Bernstein, P.A. <![CDATA[Not Guilty Harford County Assault]]> https://www.noplea.com/?p=48741 2026-03-02T21:47:31Z 2026-03-02T21:47:31Z As the Protective Order is being served by FOUR  police officers the "victim" is calling my client.  He shows the phone to the police who tell him he cannot answer it without potentially violating the piece of paper they  are handing him.  This followed a text message sent the day before telling him she shouldn't have taken it out and will dismiss it.  She then shows up at the first Hearing that he doesn't have to attend and tells the judge it is not as bad as she wrote but still needs protection.  OF COURSE she does not show up for the Final Hearing and it is dismissed. Now we come to the criminal case.  I have about 50 pages of HER TEXTS apologizing and sending him money for the cell phone SHE destroyed.  The crime occurred when he grabbed his wallet from her as she was about to flush it down the toilet.  Oh, the argument originated when he tried to help her daughter when she said she would kill herself.  That act of kindness was taken to be an insult to the "victim's" parenting skills. He also had the AUDACITY not to return her texts after he was served with the Protective Order requiring him to not have contact with her.  She took the failure to respond to mean that he was now seeing someone else. I learn right before the  trial that she told the State's paralegal that he didn't intend to assault her and it was inadvertent.  Yes that should have been disclosed!!!  This piece of crap goes to trial anyway and the Judge finds him not guilty.  He wants to sue her to get back the money he paid me for 2both matters, but she has no money and he wants an Expungement. The post script to this is that as we walked out, we see her in the hallway LAUGHING, I told my client and his best friend (who brought him to me), that if he ever has any contact with her again he would be the DUMBEST person I have ever represented. Meanwhile legitimate victims of domestic violence can take comfort that the Judge who heard this crap will not hold it against them when they appear before him.]]> by Gary S. Bernstein, P.A. <![CDATA[DUI DISMISSAL BALTIMORE COUNTY]]> https://www.noplea.com/?p=48735 2026-01-09T22:20:52Z 2026-01-09T22:20:52Z My client is under 21 so any alcohol violates his license restriction, HOWEVER he still has to blow a .08 or higher to have his license confiscated and a Temporary issued.  The Trooper told him that if he blew a .02, because he was under 21, he would have his license confiscated.  He told him for under 21 the level was not .08 but .02.  Nonsense!!! I filed a Motion to have the jury advised that because of this erroneous information my client was entitled to have in evidence a reading of .00-.05 which is a presumption that not DUI or DWI.  Hard to convict when the client is presumed sober.  So he is signing his Expungement and the incarcerable charges will be removed from the State's records.]]> by Gary S. Now if you take the time to look it up, you'll see that the picture I had taken at the last minute looks like a mug shot. I WANT TO ASSURE YOU IT IS NOT A MUG SHOT AND I HAVE NOT SERVED TIME (AT LEAST AS OF YET). I think I have now made every list or received every honor for the way I practice criminal law.   I have never taken this profession for granted and work just as hard now as I did when I first passed the bar.  I always say that nobody loves this more than I do, and it is just a fact.  They will carry me dead out of a courtroom one day, but it better be after a NOT GUILTY verdict. I am flattered to be included in this List but it just reenforces that I will continue to defend my clients with zeal and try to improve their lives along the way. Bernstein, P.A. <![CDATA[Harford County Not Guilty DUI]]> https://www.noplea.com/?p=48722 2025-05-15T15:27:29Z 2025-05-15T15:27:29Z Neither officer detected any odor of alcohol on her breath or person.  My client was able to provide all of her personal information.  Her speech was not always clear, but she had been clocked by the airbag and she was crying.  The State subpoenaed her medical records believing it would provide evidence of her intoxication.  Well, the records did not help.  She was found to alert and verbal.  Her discharge stated, "no evidence of intoxication." The judge stated that she had to find beyond a reasonable doubt that the State proved a DUI or DWI.  Although she thought my client could be impaired, that is not the standard, and therefore she found my client Not Guilty.]]> by Gary S. Bernstein, P.A. <![CDATA[Cross-Examining a Lying Sack of S…]]> https://www.noplea.com/?p=48720 2025-04-28T21:27:45Z 2025-04-28T21:27:45Z Now when my client blocked her cell phone, she used another cellphone to threaten HIM!!  Whose phone?????  She wasn't sure if she knew the number or if the messages were sent by her EVEN THOUGH it said hi this is (her name).  Well nothing pisses me off more than a perjurer.  After denying, denying, and denying it was her daughter's phone she had borrowed, we took her phone and had her check her daughter's phone number WHICH, OF COURSE, was the number the texts were sent from.  She then "confessed" ti using her daughter's phone.  She also "confessed" that other than threatening to tell his wife about the affair, she never accused him of any assaultive behavior or any fear.  Even the judge had to jump in to ask her if she sent the messages.  The judge also had to jump in to keep me from jumping into the witness box during my up close and personal cross-examination. By the time she got off the witness stand, the judge couldn't believe anything she said and threw the case out.  The Complainant didn't give the messages to her lawyer before the trial even though some of them were from her phone.  I felt sorry for her legal aid lawyer, as she could only sit there silently while her client got KILLED.  As much as my client would like to sue this liar for bringing this case, the Complainant has nothing and  is one step ahead of I.C.E..  It is ok to be pissed off and feel used, but it is not ok to make up a story and use the courts for revenge.]]>
