Tough Times Call For Tough Representation

Assertive. Passionate. Honest.

When you have a legal problem, a lukewarm response could mean losing the freedom, compensation and justice you need. Instead, you need and deserve a forceful attorney who will stand firmly in your corner and fight for your best interests. That fighter is me, attorney Gary S. Bernstein. I do not accept the status quo, and I never back down from a challenge. I am the type of lawyer who opposing counsel does not want to confront because when I take a case to court, I put the full force of my knowledge and over four decades of legal experience to work at every turn.

People don’t hire a law firm to go to court for them, they hire an attorney, and that’s exactly what you’ll get when you contact my law office, Gary S. Bernstein, P.A.

Who will be the first person you speak with on the phone or via email? Me.

Who will be the one asking questions, getting answers, doing thorough research, putting together a strong case and keeping you updated? Me.

Who will be there in court advocating for your best interests and the best possible outcome? Me.

In addition to personally handling your case, you can expect complete honesty from me – even if you don’t like the answer I’m giving you. I pride myself on laying out all of my client’s options and honestly indicating which one I think makes the most sense for their situation. Not every case is winnable, but I will use every resource I have at my disposal to minimize a sentence and the collateral consequences from a conviction.

I Take A ‘No-Plea’ Approach

A lot of people think that taking a plea deal is the best approach to resolving a criminal matter, but this couldn’t be further from the truth for a lot of people. While it may resolve matters quickly, it’s important to know that police and prosecutors aren’t looking out for your best interests. A plea deal can still result in negative consequences that can have a lasting impact on your life and rights.

I am not simply looking for the easy way out; I am looking for the best possible outcome. I will look at your case from every angle, scrutinize every detail to get to the bottom of what really happened, and will develop a strategy that truly seeks the best outcome. A lot of lawyers won’t take this type of approach. They want to get out of court quickly or take a plea deal that may not be in their clients’ best interests, but not me. I know that sometimes the best place to get the best outcome is in the courtroom.  Read the Blog about the Park Ranger charged with raping 2 Baltimore County Police Officers and who they claimed confessed.  After a one week trial he was acquitted of both Rapes because I found the evidence that showed the charges were false and that he did not confess.

Whether I’m handling a first-time DUI charge, a drug trafficking case or other criminal matters at the state or federal level, filing an appeal before the Court of Appeals or the Court of Special Appeals, or representing a loved one or family in a wrongful death case, my approach will be the same: passionate, hard-hitting and with the goal to win.

My Achievements Speak Volumes

There are few better ways to determine the integrity of an attorney than looking at his or her achievements, successes and accolades. Here are some of the many distinctions I have garnered over the years:

  • More than 40 years of legal experience as a former prosecutor and now a defense attorney
  • Selected for inclusion in Maryland Super Lawyers from 2007-2024 in the area of criminal defense: DUI/DWI
  • Selected for Best Lawyers in America from 2008-2023
  • AV Preeminent peer review-rated,* the highest rating, through Martindale-Hubbell
  • Co-authored several books, including “Handling DWI Cases” and “Criminal Practice and Procedure in the District Court of Maryland,” which are referenced by judges in Maryland
  • Taught continuing legal education courses for criminal defense lawyers since 1982
  • Hold a 10.0 rating and 5-out-of-5 star rating on Avvo

In addition to these distinctions, in 2013, I also completed the National Highway Traffic and Safety Administration (NHTSA) training course for administration of Standardized Field Sobriety Tests, which has given me an inside look at how Maryland law enforcement officers administer these tests so I am better equipped to identify missteps that result in the violation of someone’s rights.
