My latest AVVO review is about a case I took just before the trial. It was an Ex Parte Hearing where my client was accused of assaultive behavior. The Complainant was a disgruntled girlfriend “in fear” for her safety. A total crock of shit!!! I had a small booklet of messages this woman “in fear” sent to my client AND his wife who she stalked to the point that the week before the wife got a restraint order AGAINST HER. Hard to be afraid and chase after the defendant and his wife.
Now when my client blocked her cell phone, she used another cellphone to threaten HIM!! Whose phone????? She wasn’t sure if she knew the number or if the messages were sent by her EVEN THOUGH it said hi this is (her name). Well nothing pisses me off more than a perjurer. After denying, denying, and denying it was her daughter’s phone she had borrowed, we took her phone and had her check her daughter’s phone number WHICH, OF COURSE, was the number the texts were sent from. She then “confessed” ti using her daughter’s phone. She also “confessed” that other than threatening to tell his wife about the affair, she never accused him of any assaultive behavior or any fear. Even the judge had to jump in to ask her if she sent the messages. The judge also had to jump in to keep me from jumping into the witness box during my up close and personal cross-examination. By the time she got off the witness stand, the judge couldn’t believe anything she said and threw the case out. The Complainant didn’t give the messages to her lawyer before the trial even though some of them were from her phone. I felt sorry for her legal aid lawyer, as she could only sit there silently while her client got KILLED. As much as my client would like to sue this liar for bringing this case, the Complainant has nothing and is one step ahead of I.C.E.. It is ok to be pissed off and feel used, but it is not ok to make up a story and use the courts for revenge.
