I had a jury trial last week in Harford County and my client was acquitted of the DUI charges and the traffic control device charge. I had told the prosecutor, the Deputy State’s Attorney, and the first judge we appeared in front of that it was going to be a Not Guilty, but that the State was going to try the case anyway. The State had reasons to try it and Harford County does not want to dismiss any criminal charges. It is basically an office policy to let a judge or jury decide a case.
My client performed extremely well on the SFSTs, and the driving infractions were not egregious. The jury was only out a 1/2 hour before resolving the case. The offer in the case was a PBJ to the DWI, but I knew we were playing with “house money” as that was the worst that would happen if we lost the case. They are not all this easy, but it is great when you have a case you can try.
